1. Acceptance
By accessing, downloading, installing, browsing, or using YTT Weather, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use the service.
If you use the service on behalf of a company, organization, school, employer, or other entity, you represent that you have authority to bind that entity to these terms.
2. Eligibility and authority
You must have legal capacity to enter into a binding agreement to use the service. If you are below the age of majority where you live, you may use the service only with the involvement of a parent or guardian, to the extent local law allows.
3. Changes to the service or terms
We may modify, suspend, discontinue, or update any part of the service at any time, including features, data sources, design, pricing, platforms, permissions, integrations, or availability. We may also revise these terms from time to time.
If we make a material change, we may update the date above and may provide additional notice in the app, on the website, in a store listing, or through another reasonable channel. By continuing to use the service after revised terms become effective, you agree to the revised terms, subject to applicable law.
4. Service description
YTT Weather provides weather comparisons and related location-aware information such as place search, reverse geocoding, current-location matching, and comparisons across yesterday, today, and tomorrow. Features may vary by device, browser, operating system, app store, jurisdiction, network conditions, and product version.
5. Weather and safety disclaimers
Weather information can be incomplete, delayed, inaccurate, generalized, or wrong. Actual conditions may differ materially from any forecast or summary shown in the app.
- Do not rely on the service for emergency, safety-critical, mission-critical, life-safety, aviation, maritime, medical, disaster response, insurance, legal, workplace compliance, agricultural, or other high-risk decisions.
- You remain solely responsible for checking official forecasts, government alerts, and conditions on the ground when safety or material consequences matter.
- Location accuracy, reverse geocoding, time-zone resolution, and place matching may be approximate or wrong, especially when permissions are denied, connections are limited, or third-party data sources are unavailable.
6. Permissions and device settings
Some features depend on permissions or device capabilities, including location, networking, storage, notifications, background execution, and platform-level controls. You are responsible for your own device settings and for understanding how your browser, operating system, or app store handles permissions.
If you deny or revoke permissions, the service may be degraded, inaccurate, or partly unavailable. We are not responsible for failures caused by device settings, browser limitations, OS restrictions, app store policies, carrier problems, or third-party platform behavior.
7. Accounts and credentials
The current service may not require an account, but future versions may introduce accounts, subscriptions, saved sync, sign-in, support portals, or purchase records. If you create or use credentials, you are responsible for safeguarding them and for all activity that occurs under your account unless prohibited by law.
8. License grant
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the service for your own lawful internal, personal, or business purposes as expressly permitted by us.
This license does not transfer ownership of the service or any intellectual property rights to you.
9. Acceptable use restrictions
You may not, and may not attempt to, directly or indirectly:
- Copy, reproduce, modify, distribute, sell, lease, license, scrape at scale, or commercially exploit the service except as expressly authorized.
- Reverse engineer, decompile, disassemble, or attempt to derive source code or underlying models, except to the extent such restriction is prohibited by law.
- Interfere with security, integrity, rate limits, access controls, or the normal operation of the service.
- Use the service in a way that violates law, infringes rights, or facilitates harassment, surveillance abuse, fraud, or harmful conduct.
- Access the service through unauthorized automation, bots, or bulk extraction tools in a way that burdens infrastructure, violates third-party provider terms, or exceeds granted rights.
- Remove proprietary notices or misrepresent your affiliation with us.
10. Your content and feedback
If you submit suggestions, feedback, bug reports, ideas, ratings, reviews, support content, or other materials, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, distribute, display, and otherwise exploit that material for any lawful purpose, unless applicable law requires otherwise.
You represent that you have the rights needed to submit any material you provide and that your submission does not violate law or third-party rights.
11. Third-party services and stores
The service may depend on third-party APIs, weather providers, mapping or geocoding providers, cloud services, analytics or diagnostics vendors, payment processors, browsers, mobile operating systems, and app stores. Their availability and performance are outside our control.
- Your use of third-party services may also be subject to their separate terms and privacy notices.
- App stores and device platforms may impose additional usage rules, refund policies, content rules, or technical restrictions.
- To the extent required by a store platform, that platform and its affiliates may be third-party beneficiaries of the limited app license granted to you.
12. Paid features and subscriptions
If we later offer paid features, subscriptions, upgrades, donations, or other charges, additional commercial terms may apply. Prices, taxes, billing cycles, trial terms, renewal terms, refund rights, and payment methods may vary by platform, jurisdiction, and app store.
Unless otherwise required by law or the relevant platform, fees may be non-refundable once charged. We may change or discontinue paid features at any time subject to applicable law.
13. Intellectual property
The service, including software, design, text, graphics, branding, logos, interfaces, code, compilations, and other content, is owned by us or our licensors and is protected by intellectual property and other laws. All rights not expressly granted are reserved.
14. Privacy
Our Privacy Policy describes how we collect, use, and disclose data. By using the service, you acknowledge that your information may be handled as described in that policy.
15. Disclaimers of warranties
To the maximum extent permitted by law, the service is provided as is, as available, with all faults, and without warranties or representations of any kind, whether express, implied, statutory, or otherwise.
- We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, accuracy, completeness, reliability, timeliness, availability, interoperability, and results.
- We do not warrant that the service will be uninterrupted, secure, error-free, up-to-date, compatible with your device, or free from harmful components.
- No advice or information obtained through the service creates any warranty unless we explicitly state so in writing.
16. Limitation of liability
To the maximum extent permitted by law, we and our affiliates, officers, employees, contractors, licensors, suppliers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, business, goodwill, data, use, opportunity, reputation, or other intangible losses, arising out of or relating to the service or these terms.
To the maximum extent permitted by law, our aggregate liability for all claims relating to the service or these terms will not exceed the greater of:
- the amount you paid us for the service in the 12 months before the claim arose; or
- USD $100.
These limitations apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
17. Indemnity
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless us and our affiliates, officers, employees, contractors, licensors, and partners from and against claims, liabilities, damages, judgments, losses, costs, expenses, and fees arising out of or related to your use of the service, your violation of these terms, your violation of law, or your infringement of any right of another person or entity.
18. Suspension and termination
We may suspend, restrict, disable, or terminate your access to the service, in whole or in part, at any time, with or without notice, if we reasonably believe it is necessary to protect the service, comply with law, respond to abuse, avoid liability, or address security, operational, or business concerns.
You may stop using the service at any time. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, dispute provisions, and any accrued rights or obligations.
19. Export controls and sanctions
You may not use, export, re-export, or transfer the service except as authorized by applicable law, including export control and sanctions laws of the United States and other relevant jurisdictions. You represent that you are not located in, organized under, or ordinarily resident in a restricted jurisdiction where such use is prohibited, and that you are not on a prohibited or restricted-party list.
20. Governing law and disputes
These terms and any dispute arising out of or relating to them or the service will be governed by the laws of Spain, without regard to conflict-of-law principles, except to the extent consumer law in your place of residence applies and cannot be excluded.
Unless applicable law requires otherwise, the exclusive courts for disputes will be the competent courts of Spain.
21. Consumer rights and local overrides
Nothing in these terms is intended to waive rights that cannot legally be waived. If the law of your jurisdiction grants you rights or remedies that conflict with these terms, those non-waivable rights will control to the extent of the conflict.
22. Miscellaneous
- These terms, together with the Privacy Policy and any additional terms properly incorporated by reference, form the entire agreement between you and us regarding the service.
- If any provision is held unenforceable, the remaining provisions will remain in effect to the maximum extent permitted by law.
- Our failure to enforce any provision is not a waiver of that provision or any other provision.
- We may assign these terms, in whole or in part, in connection with a merger, acquisition, financing, reorganization, or sale of assets. You may not assign them without our prior written consent where such consent is legally permitted.
- Headings are for convenience only and do not affect interpretation.
- The service may be subject to force majeure events and other causes outside our reasonable control.
